Legal Proceedings Watch / Industry

In Brief

The UK Competition Appeal Tribunal has listed September 28–29 hearings in BSV Claims Limited’s case against cryptocurrency exchanges, addressing amendments to the pleadings and the continued certification of the collective proceedings.

The hearing follows the exhaustion of appeals against the tribunal’s earlier decision. No order or judgment from the September hearing appeared on the public case page when checked for this September 29 edition.

Remaining Proceedings Return to the Tribunal

The tribunal’s current listing identifies two matters for consideration: changes to the parties’ formal pleadings and whether the proceedings remain certified to continue collectively.

A case management conference previously scheduled for June 12 was vacated. The replacement hearing was listed for September 28 and 29, with an estimated duration of one and a half days and a further half-day held in reserve.

The official listing establishes the hearing’s scope. Its outcome remains to be confirmed through the tribunal’s published record. (Competition Appeal Tribunal — Case Record)

Earlier Rulings Narrowed the Claim

In its July 26, 2024 judgment, the tribunal granted a collective proceedings order while striking out the loss-of-chance claim for sub-class B. Its published summary also identified funding and subsequent case management as matters requiring attention.

That decision concerned certification and the permissible scope of the claim; it did not establish the exchanges’ liability for the alleged conduct. (Competition Appeal Tribunal — 2024 Judgment Summary)

The Court of Appeal dismissed the class representative’s appeal on May 21, 2025, according to the tribunal’s case record. The Supreme Court subsequently refused permission to appeal on December 8, 2025. Its case page states that the application raised no arguable point of law or point of law of general public importance. (UK Supreme Court — UKSC/2025/0120)

Claimant Continues to Pursue Remaining Claims

The proceedings concern alleged coordination around the delisting of the BSV token in 2019. BSV Claims Limited says it acts for UK consumers who held the token on April 11, 2019, in claims against Binance, Kraken, Bittylicious and ShapeShift.

The class representative’s current website estimates the remaining claim at between £122 million and £140 million. That figure is the claimant’s estimate, not a damages award or a finding of liability. The website says a further update will follow the hearing. (BSV Claims Limited — About the Claim)

BSV TIMES Read

The immediate issue is how the remaining claim proceeds after the appeal process.

The next substantive update should clarify whether collective certification is retained, which pleading amendments are permitted and what timetable follows. Those developments should be assessed against the tribunal’s resulting order or judgment.

For this edition, the verified development is the hearing on those questions. The public record reviewed does not yet establish its outcome.
